使用條款及私隱政策

1. 使用條款

一、手機應用程式服務

科大醫院手機應用程式（下簡稱“本程式”）是科大醫院的電子平台，方便公眾透過網上辦理多項服務，以及獲取各項服務的申辦進度和資訊。科大醫院負責本程式的維護，以確保本程式的正常運作、相關內容合法及適時更新。

二、使用者權利與義務

未得到科大醫院的書面授權，禁止對本程式全部或部分內容作任何形式的商業性複製或再發佈，並禁止藉複製或再發佈本程式任何內容而以任何名義收受利益，無論是商業性或非商業性複製或再發佈，均不可以修改任何內容。

使用者在使用和傳播本程式所載內容時，應清楚註明內容來源為本程式（名稱如下）和取得內容的日期：

英文：University Hospital Mobile Application, Macau

凡使用本程式者，即表示無條件接受本使用條款，否則切勿使用本程式。

三、免責聲明

科大醫院將因應本程式的發展，隨時對本使用條款的內容作出修訂，而且不作事先通知。

科大醫院會盡力確保內容的準確性，但並不對該等內容作出任何明示或隱含的保證及承諾，因瀏覽本程式、使用及傳播本程式的內容而引致的任何損失或損害，以及相關責任，由使用者自行承擔。

本程式提供通往其他網站或應用程式的超連結僅為方便使用者，當使用者通過該等超連結進入其他網站或應用程式，應先了解其他網站或應用程式的使用條款和私隱政策。科大醫院對使用該等網站或應用程式而導致的損失或損害不承擔任何責任。

當使用者使用本程式的“線上支付”服務時，代表使用者已從本程式轉入至第三方信用機構或銀行的支付平台，本程式將不會收集使用者於支付平台輸入的任何資訊。科大醫院對支付平台的使用條款和私隱政策不負任何責任，因此建議使用者有需要時先了解有關支付平台的使用條款和私隱政策。

四、知識產權

本程式所有內容（包括文字、圖片、聲音、影像、程式，以及數據等）的著作權屬科大醫院擁有，並受澳門特別行政區有關法例及有關著作權的國際條約所保護。

五、法律適用及管轄權

因瀏覽、使用及傳播本程式的內容而引致的任何糾紛或訴訟，適用澳門特別行政區相關法例，並受澳門特別行政區法院管轄。使用本程式，即表示同意及接受相關法律適用及管轄權。

2. 私隱聲明

一、收集之非個人資料及處理

1. 如果使用者僅瀏覽科大醫院手機應用程式（下簡稱“本程式”），而非使用本程式的服務或提交申請，本程式不會收集任何足以辨識使用者身份的資料。然而，本程式所用的軟件會自動記錄使用者所在的互聯網域名、IP地址和地區、瀏覽開始和結束日期與時間，以及曾瀏覽的網頁。一般情況下，科大醫院只會將該等資料作統計用途。除非發現該等訪問對本程式進行敵意攻擊，否則不會通過這資料去追查瀏覽者，而當涉及違反法律之行為（如攻擊本程式）時，基於調查的需要，科大醫院可能會向執法機關提供所記錄的資料；執法機關可能利用該等資料追查作出不法行為的人士及依法處理。

2. 在使用本程式時，所執行的軟件有可能會使用“cookies”技術記錄使用者的使用情況，以便之後按使用者習慣運行，讓其有更好體驗。如果使用者的瀏覽器啟動了偵測“cookies”，則每次存儲，“cookies”時均可能收到警告訊息。

3. 科大醫院有可能使用本程式所收集的資科作推送通知(Push Notification)。

二、收集之個人資料及處理

1. 每當使用者透過本程式提供個人資料時，使用者即被視作同意本私隱聲明之條款及同意本程式根據有關規定進行資料收集和使用。

2. 科大醫院會按照第8/2005號法律《個人資料保護法》的規定處理有關個人資料。

3. 在使用本程式的電子服務時，使用者有可能需要登入科大醫院手機應用程式，以及在使用服務時提供所需的個人資料。

4. 為了方便使用者，部分電子服務會顯示使用者曾經提交的資料，這樣可以令使用者無需重新輸入這些資料而縮短整個服務時間。顯示這些資料除了因為方便使用者外，也因為科大醫院有需要保持使用者的最新資料。如果這些資料已經過時，使用者可向科大醫院提出更新。

三、個人資料的保護

1. 科大醫院的工作人員負有個人資料保護的義務，使用者的個人資料處理會受到保密措施規範，並得到妥善保存。使用者的個人資料會保存直至該等資料無須再用於收集時所作的用途，或到法定的保存期限，屆時有關資料將按規定銷毀。

2. 使用者有權申請查閱、更正或更新存於本手機應用程式的個人資料。

四、風險

本程式已採用了基於Secure Sockets Layer(SSL)的安全通訊協議技術，保護個人資料在互聯網上傳輸。但有關資料在公開網絡上傳送仍會存在一定的風險，有可能被未經許可的第三者看到和使用。倘使用者對有關風險感到不安，請使用網絡以外的其他方式提供資料。

本使用條款及私隱聲明的任何更新，會用新版本取代舊版本發佈，並在文件中列明更新日期，但不作另行通告。

1. Terms of Use

1. Mobile application services

The University Hospital Mobile Application (hereinafter referred to as “this application”) is the electronic platform of University Hospital (hereinafter referred to as “UH”) to provide convenience for the public to process multiple services online and to obtain information about various services and the application progress. UH is responsible for the maintenance of this application to ensure its normal operation, and the contents are legal and updated timely.

2. Rights and obligations of users

Without the written authorisation from UH, it is prohibited to reproduce or republish all or part of the content of this application for commercial purpose in any form. It is also prohibited to reproduce or republish any content of this application for any advantage under any name. Any reproduced or republished content for commercial or non-commercial purpose is not allowed to be modified.

When using and disseminating the content of this application, users should clearly state this application (in the following names) as the source of the content and the date of extraction of the content:

Anyone who uses this application is deemed to accept the Terms of Use on an unconditional basis. Otherwise users must not use this application.

3. Disclaimer

UH may revise the content of the Terms of Use anytime without prior notice in response to the development of this application.

Whilst UH providing the content of this application endeavour to keep the content accurate, no expressed or implied assurance or guarantee is given to such content. Any loss or damage incurred due to visits of this application, use and dissemination of the content of this application, as well as the relevant liabilities, is solely borne by the users.

This application provides hyperlinks to other websites or applications for users’ convenience only. When users access other websites via such hyperlinks, they should first understand the terms of use and the privacy policies of the other websites or applications. UH bears no responsibility for the loss or damage incurred by the use of such websites or applications.

When users use the “online payment” service of this application, they are transferred from this application to a payment platform of a third-party credit institution or bank. This application will not collect any information entered onto the payment platform by the users. UH bears no responsibility for the terms of use or privacy policies of the payment platforms. Therefore, users are advised to understand the terms of use or privacy policies of such payment platforms first if needed.

4. Intellectual property

The copyright of all content (including text, images, sounds, videos, programmes, data, etc.) of this application is owned by UH and protected by the relevant laws and regulations of the Macao SAR and the international copyright treaties.

5. Legal applicability and jurisdiction

Any dispute or lawsuit incurred by browsing, use and dissemination of the content of this application is subject to the relevant laws and regulations of the Macao SAR and under the jurisdiction of the Courts of the Macao SAR. When users use this application, they are deemed to accept and agree to the relevant legal applicability and jurisdiction.

2. Privacy Statement

1. Collection of non-personal information and processing

1. If users merely browse the University Hospital Mobile Application (hereinafter referred to as “this application”) but do not use it for service applications, this submission of application will not collect any personal identifiable information of users. However, the software of this application automatically records the Internet domain name, IP address and region of the users, the start and end dates and time of visits, and the visited websites. Under general circumstances, University Hospital (hereinafter referred to as UH) only uses such information for statistical purposes. Unless the visits are found to be hostile attacks to this application, the information will not be used for tracking the users. However, when violations of the law are involved (e.g. attacks to this application), for the requirements of investigations, UH may provide the recorded information to law enforcement authorities which may use such information to track the offenders and process the case in accordance with the law.

2. When users use this application, the executed software may take records of the users’ usage through the technology of “cookies” so as to operate according to the users’ habits subsequently to offer better experience. If users have activated detection of “cookies”, they may receive a warning message each time a “cookie” is stored.

3. UH may use the information collected by this application for push notifications.

2. Collection of personal information and processing

1. Whenever users provide personal information through this application, they are deemed to agree to the terms of this Privacy Statement and give consent to this application to collect and use the information in accordance with the relevant stipulations.

2. UH is required to process the relevant personal information in accordance with the stipulations of Law no.8/2005 “Personal Data Protection Act”.

3. When using the electronic services of this application, users may be required to log in to their UH mobile application and provide personal information needed for using the services.

4. For the convenience of users, some electronic services may show the information previously submitted by users so that users do not need to fill in such information again, thus shortening the whole service duration. Showing such information is not only for the convenience of service applicants, but it is also for UH to keep such information updated. If such information is outdated, users can update UH on the change of information.

3. Protection of personal information

1. The staff of UH observe all stipulations related to the protection of personal information. The processing of the users’ personal information is regulated by measures for confidentiality and the information is stored properly. The personal information of users will be stored until such information no longer serves the purposes upon collection or the expiry of the storage period stipulated by the law. The information concerned will then be destroyed according to the stipulations.

2. Users have the right to apply for perusal, correction or update of the personal information stored in this mobile application.

4. Risks

This application has adopted the technology of safe communication protocol based on the Secure Sockets Layer (SSL) to protect the transmission of personal information on the Internet. Nevertheless, there are still certain risks when transferring such information in open networks as it may be seen or used by unauthorised third parties. If users are concerned about the risks, please provide information in ways other than using the Internet.

Any updates to the Terms of Use and Policy Statement will be published in a new version replacing the old one without further notice. The date of update will be stated in the document.
